Probate or estate administration is a legal process that takes place after someone passes away in order to pay the decedent’s debts in a fair and orderly manner and to ensure that heirs receive their lawful share of the estate. In California, when somebody dies without a will and without designating an executor, the court appoints an administrator to handle the probate process. This process includes:

  • Proving that a will is valid if there is one, or identifying the closest living relatives who are entitled to inherit by law if there is no will
  • Identifying and inventorying the decedent’s property
  • Appraising any property
  • Paying outstanding debts and taxes, and distributing the remaining property as the will directs

The probate process can be timely and complicated, involving paperwork and court appearances. Any attorney or lawyer fees are paid from the funds in the estate.
